1. Scope of this Privacy Statement


(1) The protection of your personal data (herewith referred to as "data") is a large and very important concern to us. Below you will find information about the storage of data, the type of data, their purpose and our identity. We will also notify the customer concerning the first transmission and the type of data transmitted, as well as the protective measures associated with it.

(2) Personal data is all data containing information concerning the personal or material circumstances of an identified or identifiable customer. Examples include names, email addresses, home addresses, dates of birth or telephone numbers.

2. Responsible Party/Service Provider

3. Collection and Use of Your Data


(1) The extent and nature of the collection/use of your information differs depending on whether you visit our website to only retrieve information or to use services offered by us:

(8) This site uses the service "UserVoice" from the company "UserVoice Inc." based in San Francisco (USA) to record and manage contacts and feedback from visitors. Through your contact submission or feedback, UserVoice receives your IP address and email address in order to identify your account as well as the data that you enter into the UserVoice widget. d) Charts, and Statistics by Google Chart API

(9) When visiting the home page, charts and statistics by Google Chart API will be displayed. The data submitted on Google Chart is general information such as hit counters, versions (eg 1.0), date & time and country codes in terms of the number of hits. 4. Use of Cookies


(1) For our website, we use the technique of cookies. Cookies are text files that are sent as part of your visit to our website, from our web server to your browser, and stored on your computer for later retrieval.

(2) We only use so-called session cookies and temporary cookies, i.e. those which only cache for the duration of your use of our website. The purpose of these cookies is to continue to identify your computer during a visit of our website, when changing from one of our web pages to another one of our web pages, and to be able to determine the end of your visit.

(3) The cookies are deleted when you end your browser session.

(4) Whether cookies can be stored and retrieved is determined by the settings in your browser. You can disable in your browser the storing of cookies altogether, restrict it to certain websites, or configure your browser so that it will automatically notify you when a cookie should be stored and it will ask you for confirmation to do so. For full function of our website, however, it is necessary for technical reasons to allow the so called session cookies.

(5) We do not collect or store personal data in cookies in this context. We do not use any techniques that combine information obtained through cookies with user data.

5. Use of UpdateNode.com Services


(1) If you want to use the UpdateNode service, you must first register using your email address. For registration, we use the so-called Double opt-in method, i.e. your registration is not complete until you have confirmed it by clicking the link contained in a confirmation email that has been sent to you based on your request. If your confirmation does not occur promptly, your application will be automatically deleted from our database.

(2) If you use UpdateNode.com, we store the data associated with your account and that which is necessary to fulfill your contract. This information can be managed and changed in the secure customer control panel. For more information on data collection during the contractual relationship, in particular the statistical analysis of usage data, please refer to § 13-15 of the contractual Terms and Conditions.

(3) The payment is handled by the service PayPal. PayPal will submit to us your name and your payment details, but not your credit card information. Please be advised before you are redirected to the PayPal page, that PayPal will take the responsibility of collecting more data. 6 Use of Google Analytics


(1) This website uses Google Analytics, a web analytics service provided by Google Inc. ("Google"). Google Analytics also uses cookies, i.e. text files that are stored on your computer and allow an analysis of the use of the site by you. The information generated by the cookie about your use of this website are usually transferred to a server of Google in the USA and stored there. In the case of activation of IP anonymization on this website, your IP address will be truncated within a Member state of the European Union or other parties of the Agreement on the European Economic Area. Only in exceptional cases, the full IP address is sent to and shortened by a Google server in the USA. In our contract, Google will use this information to evaluate your use of the website, compiling reports on website activity and providing website-use and the Internet-use related services to us as a website operator.

(2) Your IP address is undertaken as part of Google Analytics and will not be linked with any other data held by Google.

(3) You may refuse the use of cookies by selecting the appropriate settings on your browser; we point out, however, that you may not be able to use all features of this website to their full extent in this case.

(4) We point out that this website uses Google Analytics with the extension "_anonymizeIp ()", and therefore IP addresses will only be processed as shortened in order to exclude a direct personal reference.

7. Social Media Plugins


a) Use on the main page (www.updatenode.com)

(1) We are currently utilizing social media plugins from Twitter. If you visit our site, the social media service receives information that your browser has accessed the corresponding page of our website, even if you don't have an account with this social media service or are currently not logged in to it. This information (including those referred to in § 3 para 2 of this declaration so called "data") is transmitted from your browser directly to a server of the social media service in the U.S. and stored there.

(2) If you are logged in with this social media service, the social media service can directly log your visit to our website in your account with them. If you interact with the plug-ins (eg to leave a comment), the corresponding information is also transmitted directly to a server of the social media service and stored there. The information will be published to the social media service‘s site and shown to your contacts. If you do not want the social media service to associate your collected data at our website with your user account, you must first log out with the social media service before using the plugins.

(3) The social media service can use this information for purposes of advertising, market research and need-based uses of its websites. For this purpose the social media service creates usage, interests and relationship profiles, for example, in order to receive relevant on-screen advertisements from the social media service while on our website, your activities inform others about possible services related to the services you use.

b) Use of the Blog (blog.updatenode.com)

(1) We currently use the following social media plug-ins: Facebook, Google+, Twitter, and Xing. We focus on the so-called two-click solution. That is, when you visit our site, no personal information will be passed on. Data is only transmitted to the provider of the plugin when you click on one of the plugins. You can recognize the provider of the plugin by the marking and initial seen in the greyed out boxes.

(2) When you activate the plugins, the provider receives the information that your browser has accessed from the corresponding page of our website, even if you do not have an account with the provider or are not currently logged in. This information (including the date mentioned under § 3 para 2 of this declaration) is transmitted from your browser directly to a server of the provider in the U.S. and stored there.

(3) If you logged in with this provider, the provider can associate your visit of our website directly with your account. If you interact with the plugin (i.e. leave a comment), this corresponding information is also transmitted directly to a server of the provider and stored there. The information is also published with the provider and shown to your contacts. If you do not want the provider to collect web data associated with your user account, you must log out with the provider before using the plugins.

(4) The provider may use this information for purposes of advertising, market research and for need-based reasons for the use of its websites. The provider may create usage, interest and relational profiles for you. 8. Blog Posts


If you use the blog function and leave a public comment, we will store your e-mail address and IP. This is in case of illegal content. Pseudonymous use is possible.

9. Data Security


(1) We use technical and organizational security measures to protect incurred or collected personal data, especially against manipulation, loss or unauthorized access. Our security measures are continually updated in line with technological development.

(2) The ordering process, especially the input of payment and credit card information, is encrypted using SSL technology to prevent access by unauthorized third parties.

10. Duration of Data Retention


Your personal information is kept only as long as is necessary for the provision of our services. Sometimes longer data storage may be required due to legal or regulatory obligations.

11. Rights to Cancellation, Appeal and Information


(1) We insure that you can revoke your granted data protection consent at any time, effective for the future.

(2) You may cancel the creation of your User Profile, in scope of this Privacy Statement, for advertising and market research purposes and for the tailored design of our websites at any time.

(3) You also have the option to request information about the data stored for you, even if they relate to the origin of the data, recipients or categories of recipients to which your data is propagated to, and the purpose of storage.

12. Language


This privacy policy is provided in English and German. In case of a conflict between the English and German versions of this privacy policy, the German version shall be the relevant version.
